Terms of Service

1. About FairDealWizard

FairDealWizard ("the service") is an online tool that helps families prepare HSE Fair Deal (Nursing Homes Support Scheme) applications. We are not the HSE and we do not make funding decisions. Our role is to help you complete the official HSE Fair Deal application form and assemble the required supporting documents. The HSE makes the final decision on your application.

By creating an account or paying for the service, you agree to these terms. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old. You must be applying on your own behalf, on behalf of a family member, or as a "specified person" under the Nursing Homes Support Scheme Act 2009. You are responsible for ensuring you have the legal authority to apply on someone else's behalf.

3. The service we provide

For €89 inclusive of VAT, the service includes:

  • A guided online wizard covering Parts 1-7 of the official HSE Fair Deal application
  • A personalised checklist of supporting documents based on your answers
  • Document storage for upload and retrieval up to download
  • An AI Health Check that flags gaps and quality issues before you finalise
  • The completed application as a downloadable PDF (Parts 1-4 coordinate-filled, Parts 5-7 typed appendices)
  • Reasonable email support for technical issues

We do not provide: legal advice, financial advice, advice on whether the loan or 3-year cap is right for you, advocacy with the HSE, or any guarantee of HSE approval. For advice on these matters, consult a solicitor or financial adviser.

4. Your responsibilities

  • You must provide accurate and complete information. Inaccurate information may result in HSE rejection.
  • You must keep your account credentials secure. You are responsible for activity on your account.
  • You must print, sign, and post the completed form to your local HSE Nursing Homes Support Office.
  • You must not share your generated PDF or your account access with anyone outside your immediate family.
  • You must not use the service to commit fraud, evade tax, or misrepresent assets to the HSE.

5. Payment

The service costs €89 inclusive of Irish VAT. Payment is processed by Stripe. We do not see or store your full card details. You pay only at the end, when you choose to download your completed application — you can use the wizard, get the AI Health Check, and back out at no cost.

6. Refunds

See our Refund Policy for full details. In summary: once you have downloaded the completed PDF, the digital service has been delivered and refunds are not generally available. If you have technical problems before download, contact us and we will resolve them or refund you.

7. AI Health Check disclaimer

The AI Health Check uses Anthropic's Claude AI to flag potential gaps and quality issues. It is guidance, not legal or financial advice. The AI may miss issues, produce false positives, or be wrong. The HSE makes the final determination on your application; you are responsible for the accuracy and completeness of what you submit.

8. Intellectual property

The service, including all wizard content, layouts, text, code, and design, is owned by us. You receive a personal, non-transferable licence to use the service and the generated PDF for the purpose of your Fair Deal application. You may not resell, redistribute, or commercially exploit the service.

The official HSE Fair Deal application form is © Health Service Executive. We use it under the terms of public-document availability for the purpose of helping members of the public complete it.

9. Service availability

We aim for high availability but do not guarantee 100% uptime. We are not liable for losses arising from temporary outages. Planned maintenance is announced in advance where possible.

10. Liability

To the fullest extent permitted by Irish law, our total liability under or in connection with these terms is limited to the amount you paid us in the preceding 12 months. We are not liable for: HSE decisions, indirect or consequential losses, missed deadlines caused by your delay in submitting documents, or losses you could have prevented by following our service.

Nothing in these terms limits liability for fraud, gross negligence, or anything else that cannot be limited by law (including statutory consumer rights).

11. Termination

You can close your account at any time by emailing us. We may terminate or suspend your account if you breach these terms. On termination, we will retain data only for the periods set out in our Privacy Policy.

12. Governing law

These terms are governed by Irish law. Disputes are subject to the exclusive jurisdiction of the Irish courts. Nothing in these terms affects your statutory rights as a consumer.
